Uncommon Broadband

These Terms of Service govern your use of Uncommon Broadband internet service, managed Wi-Fi, equipment, website, availability-check tools, Reservations, and related services.

By submitting a Reservation, signing up for service, paying for installation, using our service, or allowing installation of our equipment, you agree to these Terms.

1. Service Overview

Uncommon Broadband provides premium, hyperlocal broadband internet service to select serviceable locations.

Service availability is limited and depends on technical feasibility, line of sight, signal quality, building conditions, installation access, equipment placement, and network capacity.

Uncommon Broadband may decline, delay, or cancel service if a location cannot be served reliably.

2. Availability Checks

An online availability result, prequalification, invitation, or accepted Reservation does not guarantee final service.

Final service approval may require:

  • Address review

  • Unit or floor review

  • Line-of-sight review

  • Photo review

  • Installation review

  • Signal testing

  • Building or property access confirmation

  • Successful installation

If we determine your location cannot be served, any refundable Reservation payment will be refunded according to the Reservation terms in effect at the time of payment.

3. Service Profiles

Uncommon Broadband uses Service Profiles rather than traditional fixed internet packages.

A Service Profile may include details such as:

  • Monthly price

  • Service speed

  • Upload and download configuration

  • Managed Wi-Fi preference

  • Equipment configuration

  • Installation type

  • Billing terms

  • Service features

  • Any applicable limitations or special conditions

Your Service Profile will be shown during signup, on your invoice, in your service summary, or in other written communication from Uncommon Broadband.

Unless otherwise stated in writing:

  • Service is billed monthly in advance

  • Service is prepaid

  • There is no long-term service contract

  • Monthly service does not include ownership of Uncommon Broadband equipment

  • Managed Wi-Fi may be included as part of the membership

  • Service is subject to reasonable network management

Service Profile details, monthly price, installation charges, speeds, taxes, fees, data policies, and other terms may be shown separately in the applicable Broadband Facts label, order page, invoice, or service summary.

4. Reservations

Uncommon Broadband may accept Reservations to hold priority access, begin serviceability review, or place a prospective member in the installation queue.

Unless otherwise stated:

  • Reservation payments are applied toward installation, activation, or first-month service if service is installed.

  • Reservation payments are refundable if Uncommon Broadband determines your location cannot be served.

  • A Reservation does not guarantee final service.

  • Final approval may depend on line of sight, signal quality, installation conditions, building restrictions, equipment placement, network capacity, and successful installation.

  • A Reservation may be cancelled if the prospective member does not respond, refuses reasonable installation options, misses scheduled appointments, or chooses not to proceed after service has been approved.

Specific Reservation terms shown at the time of payment control if they differ from this section.

5. Installation and Activation

Standard installation may include an outdoor or window-adjacent wireless receiver, cabling, power equipment, router, Wi-Fi access point, configuration, and activation.

Installation conditions vary by location. Standard installation does not include unusual construction, wall fishing, drilling, custom wiring, complex mounting, landlord negotiation, electrical work, or repair of existing wiring unless specifically agreed in writing.

Uncommon Broadband or its contractors may refuse an installation that is unsafe, impractical, not permitted, or likely to result in poor service.

The member is responsible for ensuring that they have permission to allow installation at the service location.

6. Equipment Ownership

Unless specifically sold to you in writing, equipment provided by Uncommon Broadband remains the property of Uncommon Broadband.

This may include:

  • Outdoor wireless receiver

  • Mounts

  • Power supplies

  • Routers

  • Wi-Fi access points

  • Cabling

  • Network accessories

  • Any replacement equipment

You agree not to sell, remove, relocate, modify, damage, reset, reconfigure, or tamper with Uncommon Broadband equipment without permission.

7. Equipment Return and Unreturned Equipment Fees

If service is cancelled, terminated, or not activated after equipment is installed, Uncommon Broadband equipment must be returned or made available for recovery.

Unreturned, damaged, modified, or missing equipment may result in an equipment fee.

Unless otherwise stated in your order or invoice, estimated unreturned equipment fees are:

  • Outdoor receiver only: up to $299

  • Full managed Wi-Fi kit: up to $599

  • Additional damaged or missing equipment: actual replacement cost, labor, and recovery costs where applicable

These fees are not penalties. They represent the cost of recovering or replacing company-owned equipment.

8. Managed Wi-Fi

Managed Wi-Fi may be included with your membership. If you use Uncommon Broadband managed Wi-Fi equipment, we may configure, monitor, update, troubleshoot, and maintain that equipment.

Managed Wi-Fi support generally includes:

  • Router and access point setup

  • Network name and password assistance

  • Basic Wi-Fi troubleshooting

  • Equipment health monitoring

  • Firmware updates

  • Replacement of failed Uncommon Broadband managed Wi-Fi equipment

Managed Wi-Fi support does not include unlimited home technology support. We do not provide unlimited support for TVs, printers, computers, phones, smart home devices, game consoles, malware, work VPNs, third-party mesh systems, or member-owned networking equipment.

9. Bring Your Own Router

Managed Wi-Fi is optional.

You may use your own router or Wi-Fi system. Uncommon Broadband provides a standard Ether

net handoff and is compatible with standard home and business routers.

If you use your own router, our support responsibility generally ends at the Uncommon Broadband Ethernet handoff or installed service receiver. Your router, Wi-Fi system, internal wiring, and connected devices remain your responsibility.

10. Billing and Payment

Service is prepaid monthly.

Payment is due before the service period begins. If payment is not received, service may be suspended, limited, or cancelled.

Installation, activation, Reservation payments, monthly service, equipment fees, missed appointment fees, service call fees, or other charges may be billed separately or together.

All charges are due as stated on the invoice, payment page, Service Profile, or service summary.

11. No Contract, Cancellation, and Refunds

Unless otherwise agreed in writing, Uncommon Broadband does not require a long-term service contract.

You may cancel service by contacting Uncommon Broadband before your next billing date.

Because service is prepaid, partial-month refunds are not guaranteed unless required by law or specifically stated in writing.

If you cancel, you remain responsible for unpaid charges, equipment return, unreturned equipment fees, and any other amounts owed.

12. Speeds and Performance

Uncommon Broadband aims to provide a high-quality broadband experience, but internet performance can vary.

Actual speed and performance may depend on:

  • The Service Profile selected

  • Wireless signal quality

  • Network congestion

  • Router or Wi-Fi performance

  • Device capability

  • Building materials

  • Interference

  • Internet destination

  • Upstream provider performance

  • Weather or environmental conditions

  • Equipment placement

Advertised or configured speeds are not guaranteed at every moment or to every internet destination.

13. Network Management

Uncommon Broadband may use reasonable network management practices to operate the network, reduce congestion, protect security, prevent abuse, maintain service quality, and comply with law.

Network management may include:

  • Rate limiting according to Service Profile

  • Prioritizing network control and security traffic

  • Blocking malicious traffic

  • Filtering spam, denial-of-service traffic, or known threats

  • Suspending infected, abusive, or harmful devices

  • Managing congestion

  • Applying temporary service limitations during outages or emergencies

We do not block lawful content for anti-competitive reasons.

14. Acceptable Use

You agree not to use Uncommon Broadband service for unlawful, abusive, harmful, or disruptive activity.

Prohibited uses include:

  • Illegal activity

  • Network attacks

  • Hacking or unauthorized access

  • Malware distribution

  • Spam

  • Phishing

  • Copyright infringement

  • Harassment or threats

  • Excessive automated traffic that harms the network

  • Reselling or redistributing service without written permission

  • Hosting services that disrupt network performance or violate law

  • Interfering with other members or network equipment

  • Attempting to bypass security, authentication, rate limits, or service controls

We may suspend or terminate service for violation of this section.

15. Member Responsibilities

You are responsible for:

  • Providing accurate account and service information

  • Maintaining power to installed equipment

  • Keeping Uncommon Broadband equipment safe

  • Allowing reasonable access for installation, service, repair, or equipment recovery

  • Keeping payment information current

  • Securing your devices and passwords

  • Using the service lawfully

  • Getting any required permission for installation at your location

  • Reporting service problems promptly

16. Service Calls and Missed Appointments

If service trouble is caused by Uncommon Broadband equipment or network issues, we will work to resolve it.

If a service call is caused by member-owned equipment, member damage, moved equipment, power issues, unsafe access, missed appointments, or non-service-related home technology issues, a service call or truck roll fee may apply.

Missed or cancelled appointments without reasonable notice may result in a missed appointment fee.

17. Outages and Maintenance

Service may be interrupted by maintenance, equipment failure, power issues, upstream provider issues, weather, obstruction, interference, emergencies, or events outside our control.

We may perform scheduled or emergency maintenance as needed.

Uncommon Broadband is not liable for losses caused by service interruption, including lost income, missed work, business interruption, lost data, security system failure, or inability to use internet-connected devices.

18. Member Communications

We may contact you by email, phone, SMS, website chat, invoice notice, or account message regarding availability, Reservations, installation, service, billing, outages, support, or account matters.

By providing your contact information, you authorize us to contact you about your account and service.

You may opt out of marketing communications, but service-related messages may still be sent when needed.

19. Privacy

Use of Uncommon Broadband service is also governed by our Privacy Policy.

The Privacy Policy explains what information we collect, how we use it, how we share it, and how to contact us with privacy questions.

20. Copyright and DMCA

Uncommon Broadband respects intellectual property rights.

If we receive a copyright or DMCA notice related to your account, we may forward the notice, contact you, suspend service, terminate service for repeat infringement, or take other action required or allowed by law.

You are responsible for activity occurring through your connection.

21. Suspension and Termination

We may suspend, limit, or terminate service if:

  • Payment is not received

  • You violate these Terms

  • You misuse the network

  • You damage or tamper with equipment

  • Service cannot be safely or reliably provided

  • Required access is denied

  • We are required to do so by law

  • Continued service creates risk to Uncommon Broadband, other members, or the network

Termination does not waive amounts owed.

22. Changes to Service, Service Profiles, or Terms

We may update Service Profiles, pricing, policies, service features, or these Terms from time to time.

If a material change affects active members, we will provide reasonable notice by website posting, email, invoice message, or other account communication.

Continued use of service after changes take effect means you accept the updated Terms.

23. Limitation of Liability

To the fullest extent allowed by law, Uncommon Broadband is not liable for indirect, incidental, consequential, special, punitive, or lost-profit damages.

This includes damages related to service interruptions, reduced speeds, outages, data loss, security incidents, third-party services, missed work, business interruption, or inability to access internet-connected systems.

Our total liability for any claim related to service is limited to the amount you paid for service during the one-month period before the claim arose, unless a different limit is required by law.

24. No Warranties

Service is provided on an “as available” and “as provided” basis.

We do not guarantee uninterrupted service, error-free service, specific speeds at all times, compatibility with every device, or access to every internet destination.

25. Indemnification

You agree to defend, indemnify, and hold harmless Uncommon Broadband from claims, damages, costs, and expenses arising from your misuse of service, violation of these Terms, illegal activity, infringement, member-owned equipment, unauthorized sharing of service, or damage to Uncommon Broadband equipment.

26. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law rules.

Venue for disputes will be in the state or federal courts serving Multnomah County, Oregon, unless another venue is required by law.

  5. For clarity, a refundable reservation is offered only after an address appears likely to qualify and begins serviceability review. It does not confer priority access.
